A 1984 graduate of Texas Tech University School of Law, Mr. Elder has been Board Certified by the Texas Board of Legal Specialization since 1989 in the areas of Commercial, Residential and Farm & Ranch Real Estate Law.

Mr. Elder has extensive experience in representing parties to complex commercial transactions. Representative transactions include:

  1. The negotiations and sale of electric transmission assets.
  2. The sale and purchase of land line exchanges, cable and satellite TV systems, wireless assets, long haul fiber routes and other telecommunications assets.
  3. Lead counsel for equity owner/lenders in the construction of Westin Hotel/Golf Course resort properties.
  4. Outside counsel and blind trustee for Texas Tech University in the purchase of a high rise office building.
  5. Lead counsel for a consortium of Lubbock banks to fund the inception of Overton Parke in Lubbock, the largest private redevelopment project in the United States.
  6. Representing borrowers and doing title exam work for cooperative and other utility companies to obtain in excess of One Billion dollars of loans from Rural Utilities Services/REA, National Rural Utility Cooperative Finance Corporation, Rural Telephone Finance Cooperative and CoBank, ACB.
  7. Representing lenders and developers in residential subdivision developments.
  8. Representing sellers, buyers, owners, and lenders in the construction, sale and purchase of hotel and motel properties.
  9. Interconnection agreements with wind farms and other electric generators/providers.
  10. Telecommunications interconnection agreements.
Mr. Elder is a member of the State Bar of Texas, the Electric Cooperative Bar Association, and the Lubbock County Bar Association. In 2003, he was designated a Texas Super Lawyer in the area of real estate by Texas Monthly and Law & Politics magazines. He is admitted to practice in the courts of the State of Texas, the United States District Court for the Northern District of Texas, the United States Court of Appeals, Fifth Circuit, and the United States Supreme Court.

Mr. Elder’s practice is focused in the areas of commercial transactions, with extensive experience in real estate, utility, banking, business entities, oil & gas, wills & probate and employment law.

Dulan D. Elder’s early legal practice was concentrated in the area of banking, oil and gas and real estate. He has examined many abstracts and conducted stand-up title examinations and rendered title opinions on farm and ranch properties as well as giving drilling and division order title opinions. This extensive title and lending background serves him well in representing cooperatives in lending transactions. Over time, Mr. Elder became heavily involved in the representation of agricultural cooperatives in addition to his involvement with utility cooperatives. As the focus of the Firm has turned towards cooperatives, Mr. Elder has applied his extensive experience in multiple facets of complex commercial transactions to the needs of cooperatives.

Mr. Elder is married to his wife of 30 years, Rae Ann, and has three children, Thomas, a Project Engineer for National Oilwell Varco, Alison, a Peace Corps Volunteer in Morocco, and Lori, a recent graduate of Texas A&M University.
